Such injury or harm may be physical, mental, financial, or emotional.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Theories_of_Victimology\"><\/span>Theories of Victimology<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li><strong>Victim Precipitation:<\/strong> This theory can be perceived as a negative approach to victims because it only focuses on how the victim&#8217;s own contribution led to their victimization.<\/li>\n<li><strong>Three-Model Theory<\/strong> (by Benjamin Mendelsohn):\n<ol type=\"a\">\n<li>In terms of time and space: the victim being in the wrong place at the wrong time.<\/li>\n<li>Attracting factors and lifestyle create a fertile ground for crime.<\/li>\n<li>Pre-disposing factors such as being too young, too poor, a minority, unemployed, etc., may lead to victimization.<\/li>\n<\/ol>\n<\/li>\n<li><strong>Routine Activities Theory<\/strong> (by Cohen &amp; Felson): This theory presupposes that a crime occurs when three conditions come together:\n<ol type=\"a\">\n<li>A suitable target<\/li>\n<li>A motivated offender<\/li>\n<li>Absence of security, guardianship, or parental care<\/li>\n<\/ol>\n<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Classification_of_Victims\"><\/span>Classification of Victims<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<h4><span class=\"ez-toc-section\" id=\"Victims_of_Crime\"><\/span>Victims of Crime<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<ul>\n<li>Victims of injury to persons or property (e.g., murder, dowry death, grievous hurt, dacoity, robbery, assault)<\/li>\n<li>Victims of environmental offences (e.g., gas leakage, river pollution)<\/li>\n<\/ul>\n<h4><span class=\"ez-toc-section\" id=\"Victims_of_Abuse\"><\/span>Victims of Abuse<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<ul>\n<li>Third-degree methods<\/li>\n<li>Custodial torture or death<\/li>\n<li>Hospital victims<\/li>\n<li>Custodial rape<\/li>\n<li>Groundless arrest<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Impact_of_Victimization\"><\/span>Impact of Victimization<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<h4><span class=\"ez-toc-section\" id=\"Primary_Victimization\"><\/span>Primary Victimization<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<ol>\n<li><strong>Physical Impact:<\/strong> Victims may experience physical reactions like hypertension, increased heartbeat, or grief. Injuries may be apparent or emerge later. Knife or firearm injuries are often fatal. Some injuries may have permanent effects.<\/li>\n<li><strong>Financial Impact:<\/strong> This may include:\n<ol type=\"a\">\n<li>Medical treatment costs for injuries<\/li>\n<li>Damage to property or possessions<\/li>\n<li>Litigation costs<\/li>\n<li>Employment loss or reduced earnings<\/li>\n<li>Funeral or burial expenses (if applicable)<\/li>\n<\/ol>\n<\/li>\n<li><strong>Psychological Impact:<\/strong> Reflected in behavioural responses such as increased alcoholism, excessive drug use, social withdrawal, or avoidance of people.\n<p>Besides physical and financial impacts, marital and familial relationships may also suffer, especially for women who are rape or sexual offence victims. This can result in serious consequences, including the destruction of settled family life.<\/li>\n<\/ol>\n<h4><span class=\"ez-toc-section\" id=\"Secondary_Victimization\"><\/span>Secondary Victimization<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>Victims may experience institutionalized victimization when their human rights are denied due to manipulated evidence in courts or delayed medical care by hospitals until police intervention.<\/p>\n<p>Social attitudes can also cause victimization\u2014relatives, friends, and neighbors may blame the victim rather than support them.<\/p>\n<p>Victims of collective violence (e.g., riots, bomb blasts, terrorism) often suffer ongoing trauma beyond primary and secondary victimization, affecting their families long-term.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Victimology_Compensation\"><\/span>Victimology &amp; Compensation<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<h4><span class=\"ez-toc-section\" id=\"Compensatory_Relief_to_Victims\"><\/span>Compensatory Relief to Victims<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>The legislative framework for compensatory relief in India is found in the BNSS, the Probation of Offenders Act, 1958, and the Motor Vehicles Act, 1988.<\/p>\n<h4><span class=\"ez-toc-section\" id=\"Compensation_under_BNSS\"><\/span>Compensation under BNSS<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<ul>\n<li><strong>Section 395:<\/strong> Courts may order compensation for loss or injury caused by the offender.<\/li>\n<li><strong>Section 396:<\/strong> State governments, in coordination with the central government, must prepare schemes to fund compensation for victims.<\/li>\n<\/ul>\n<h4><span class=\"ez-toc-section\" id=\"Compensation_under_the_Probation_of_Offenders_Act_1958\"><\/span>Compensation under the Probation of Offenders Act, 1958<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>Section 5(1) allows courts to order the offender (released under Sections 3 or 4) to pay reasonable compensation for loss or injury to the victim.<\/p>\n<h4><span class=\"ez-toc-section\" id=\"Compensation_under_the_Motor_Vehicles_Act_1988\"><\/span>Compensation under the Motor Vehicles Act, 1988<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>Victims of vehicular accidents or their legal representatives (in case of death) may claim compensation from the offender under Section 2 of the Act.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Case_Law_Sarwan_Singh_vs_State_of_Punjab\"><\/span>Case Law: <em>Sarwan Singh vs. State of Punjab<\/em><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><b>The Supreme Court enumerated the factors to consider when awarding compensation: <\/b><\/p>\n<ul>\n<li>Offender\u2019s capacity to pay<\/li>\n<li>Nature of the offence and injury caused<\/li>\n<li>Overall effect on victim\u2019s family and social life<\/li>\n<li>Emotional and financial loss<\/li>\n<\/ul>\n<p>The Court held that the quantum must be reasonable and based on the circumstances.
