In India, censorship is practiced through various acts and legislation, including:<\/p>\n<ul>\n<li>Indian Penal Code, 1860 (Currently Bharatiya Nyaya Sanhita, 2023)<\/li>\n<li>Code of Criminal Procedure, 1973 (Bharatiya Nagarik Suraksha Sanhita, 2023)<\/li>\n<li><a href=\"\/legal\/article-2911-the-cinematograph-act-1952-the-guardian-of-victorian-morality-and-decency.html\" target=\"_blank\" rel=\"noopener\">Cinematograph Act, 1952<\/a><\/li>\n<li><a href=\"https:\/\/www.legalservicesindia.com\/article\/2490\/The-Role-of-Central-Board-of-Film-Certification.html\" target=\"_blank\" rel=\"noopener\">Central Board of Film Certification<\/a><\/li>\n<\/ul>\n<p>However, today censorship authority is often abused or misused, silencing genuine people and information that highlight public issues.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Freedom_of_Speech_and_Constitutional_Provisions\"><\/span>Freedom of Speech and Constitutional Provisions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Article 19(1)(a) of the Indian Constitution grants the <strong>Right to Freedom of Speech and Expression<\/strong>, but this right is not absolute. Article 19(2) allows the State to impose &#8220;reasonable restrictions&#8221; in the interests of:<\/p>\n<ul>\n<li>Sovereignty and integrity of India<\/li>\n<li>Public order<\/li>\n<li>Morality and decency<\/li>\n<li>National security<\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"Misuse_of_Censorship\"><\/span>Misuse of Censorship<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Despite its intent, censorship is often misused. The case of <strong>ANI<\/strong>, reported by YouTubers and media creators, highlights how content creators were allegedly exploited for using small portions of clips under fair use. This represents unethical control and exploitation of reliable sources.<\/p>\n<p><a href=\"\/legal\/article-9042-censorship-mandates-better-or-for-worse.html\" target=\"_blank\" rel=\"noopener\">Censorship<\/a> also extends to movies and media, where films on sensitive issues or based on foreign themes often face unnecessary cuts. Such practices create misinformation, diminish accountability, and erode trust in media.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Impact_on_Media_and_Publishing\"><\/span>Impact on Media and Publishing<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>These restrictions are disheartening for media houses and publishers, leading to hopelessness, reputational damage, and even exits from the profession.
