The enactment of <a href=\"\/legal\/article-2027-right-of-children-to-free-and-compulsory-education-amendment-act-2019.html\" target=\"_blank\" rel=\"noopener\"><strong>The Right of Children to Free and Compulsory Education Act, 2009<\/strong><\/a> (commonly known as the RTE Act) was a landmark development, marking the first time education became a <strong>fundamental right<\/strong> for children between the ages of six and fourteen. The Act not only recognizes education as a right but also places enforceable obligations on the state to ensure access, equity, and quality.<\/p><div id=\"ez-toc-container\" class=\"ez-toc-v2_0_82_2 The Universal Declaration of Human Rights (1948) affirms education as a fundamental human right, and subsequent international covenants such as the UN Convention on the Rights of the Child (CRC, 1989) have emphasized free and compulsory primary education for all.<\/p>\n<p>In the Indian context, education has historically been intertwined with issues of <strong>caste, gender, class, and poverty<\/strong>, leading to wide disparities in access and quality. Though India has witnessed substantial progress in literacy since independence (from 18.33% in 1951 to over 74% by 2011), significant challenges in terms of universal access and equity have persisted. The <strong>Right of Children to Free and Compulsory Education Act, 2009<\/strong> represents an attempt to rectify these imbalances by transforming education from a <em>directive principle of state policy<\/em> into a <em>justiciable fundamental right<\/em>.<\/p>\n<p>This paper seeks to evaluate the Act\u2019s potential and limitations in achieving its mandate. These challenges can be grouped into administrative, financial, pedagogical, and socio-cultural categories.<\/p>\n<ol type=\"a\">\n<li>\n<h4><span class=\"ez-toc-section\" id=\"Administrative_Challenges\"><\/span>Administrative Challenges<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>One of the most pressing administrative issues is the <strong>shortage and absenteeism of teachers<\/strong>. Nationally, more than nine lakh teacher posts remain vacant, resulting in skewed pupil-teacher ratios, especially in rural and tribal areas. Even where teachers are appointed, absenteeism remains a persistent concern, with surveys showing absentee rates as high as 25% in some states.<\/p>\n<p>Another administrative weakness is the absence of effective <strong>grievance redressal mechanisms<\/strong>. While the Act provides for State Commissions for Protection of Child Rights to oversee compliance, these bodies are often underfunded and lack enforcement powers. Furthermore, monitoring of Section 12(1)(c)\u2014which mandates private schools to reserve 25% of seats for disadvantaged children\u2014has been inconsistent.<\/li>\n<li>\n<h4><span class=\"ez-toc-section\" id=\"Financial_Challenges\"><\/span>Financial Challenges<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>Financial constraints remain a major obstacle. Brazil also allocates a fixed proportion of its GDP and municipal budgets to education, providing a more stable funding base than India\u2019s fluctuating expenditure levels. However, challenges persist in terms of regional disparities, with rural and indigenous communities often lagging behind urban areas. Nevertheless, Brazil\u2019s integrated approach underscores the importance of combining <strong>constitutional guarantees<\/strong> with financial commitments.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"South_Africa\"><\/span>South Africa<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>South Africa provides another interesting case study. Following the end of apartheid, the <strong>South African Schools Act of 1996<\/strong> established a framework for universal access to education. A key feature of this system is the introduction of <strong>\u201cno-fee schools\u201d<\/strong>, particularly in disadvantaged communities, ensuring that economic barriers do not prevent enrollment.<\/p>\n<p>Much like India\u2019s RTE provision of free and compulsory education, the South African model is designed to reduce inequality. However, unlike Brazil, it excludes <strong>early childhood education (below 6 years)<\/strong> and <strong>secondary education (above 14 years)<\/strong>, creating discontinuities in learning.<\/p>\n<p>Similarly, while South Africa\u2019s experience shows the importance of addressing structural inequalities, India too must confront disparities between government and private schooling systems. Finland\u2019s success reinforces that <strong>merely ensuring access<\/strong> is insufficient without simultaneously improving quality, teacher capacity, and local accountability.<\/p>\n<p>Thus, India\u2019s RTE Act can be viewed as a strong beginning, but it requires expansion and reimagining.
