Decisions<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<ul>\n<li>Copies of all official meetings (chaired by District Collector, officer-level meetings, public grievance redressal meetings).<\/li>\n<li>Detailed minutes (date, agenda, attendees, discussions, decisions).<\/li>\n<li>Follow-up or implementation action status on decisions taken.<\/li>\n<\/ul>\n<h4><span class=\"ez-toc-section\" id=\"Complaints_Against_Administrative_Officers\"><\/span>Complaints Against Administrative Officers<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<ul>\n<li>List of complaints received in the given period.<\/li>\n<li>Nature and subject matter of each complaint.<\/li>\n<li>Investigation process, status, and outcomes (including any disciplinary action).<\/li>\n<li>Any public reports\/summaries on complaint handling.<\/li>\n<\/ul>\n<\/section>\n<h2><span class=\"ez-toc-section\" id=\"PIO_reply_11_August_2025\"><\/span>PIO reply (11 August 2025)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The PIO replied:<\/p>\n<blockquote><p>The sought information is unclear.<\/p>\n<p>The requested data would require <em>collection and creation of new information<\/em> \u2014 under the RTI Act, only <em>existing documents\/records<\/em> (where date, year, or letter number is specifically mentioned) are provided.<\/p>\n<p>RTI does not oblige the public authority to compile and create new records.<\/p>\n<p>Applicant is advised to specify:<\/p>\n<ul>\n<li>Exact year, month, date<\/li>\n<li>Or letter\/document number<\/li>\n<\/ul>\n<p>So the relevant record can be provided.<\/p><\/blockquote>\n<h2><span class=\"ez-toc-section\" id=\"First_appeal_filed_03_September_2025\"><\/span>First appeal (filed 03 September 2025)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><strong>Grounds of Appeal:<\/strong><\/p>\n<ul>\n<li><strong>Specific Date Already Provided:<\/strong> The RTI application clearly specified the date \u201c09 August 2024\u201d for which the records were sought.<\/li>\n<li><strong>Existence of Records:<\/strong> The meetings and complaints for that date are recorded in official registers and files. I am not requesting the PIO to create or compile new information but only copies of existing records as maintained.<\/li>\n<li><strong>PIO\u2019s Obligation Under RTI Act:<\/strong> As per Section 2(f) of the RTI Act, \u201cinformation\u201d includes records, documents, memos, e-mails, minutes of meetings, orders, and reports. Providing such records does not constitute \u201ccreating\u201d new information.<\/li>\n<li><strong>Violation of Section 7(1):<\/strong> The outright refusal without supplying available documents for the given date is a violation of the spirit and provisions of the RTI Act.<\/li>\n<\/ul>\n<p><strong>Prayer:<\/strong><\/p>\n<p>In light of the above, I request the First Appellate Authority to kindly:<\/p>\n<ol>\n<li>Direct the PIO to provide the requested documents as per my original RTI dated <strong>09\/08\/2025<\/strong> for the date <strong>09\/08\/2024<\/strong> without further delay.<\/li>\n<li>Clarify to the PIO that providing existing records for a specified date does not amount to \u201ccreation\u201d of new information.<\/li>\n<\/ol>\n<h2><span class=\"ez-toc-section\" id=\"First_appeal_hearing_24_September_2025\"><\/span>First appeal hearing (24 September 2025)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>I went to the first appeal hearing today. The representative of the PIO did not say anything and the First Appellate Authority (FAA) did not appear impartial. The FAA asked me to give specific details of the information required; I replied that my RTI is specific. She then asked me to give a reason for asking this information; I replied that I do not have to give a reason under the RTI Act. She claimed Supreme Court guidelines require giving a reason. I exercised my right and did not provide a reason.<\/p>\n<p>After that she told the PIO to collect information and to ask me for an additional fee (she suggested it could be around \u20b950,000). I replied that, as the statutory timeline has passed, the PIO is not entitled to ask for an additional fee and the information should be provided free of cost. The FAA then said that she (as FAA) can ask for an additional fee. I said nothing further and left the hearing along with the PIO.
