The internet is flooded with the comments ignoring the Social Impact of the
judgement on the women and coining it as 'victim card'.
These are the same people who always terms women rights and needs as a victim
card, on the cause that because of few wrong persons they align and generalise
the whole gender. Just because of few,the legit interest at large should not be
compromised in securing the justice.
Bitter side of the truth is that every person who is into litigation is
upholding the basic requirement of 3 years practice as a lawyer while those who
are deeply indulged in the dream of judiciary are unlikely agree for the same.
Among various reasons, people also cited the reason that 'lack of ethics' and
proper understanding of courts and legal system and the impact on the litigants
life that is the question of life and liberty are primarily the causes that the
3 years of practice as a lawyer is justified.
If it is about the question of liberty and ethics, sometimes the same can be
seen missing in Higher Judiciary, where lack of experience is nowhere a chance
as Judges already serves 7 to 10 years or more into lower Judiciary or as an
Advocate. Some of the District and Additional District Judges lacks the ethics
to deal with the Bar. No denial to the fact that the question of liberty is
utmost important but the dignified treatment is also inasmuch crucial to be a
part of daily deal.
Yes, ensuring better judges is a valid goal—but at what cost?
Not at the cost of spending three years in litigation merely to realize that
private practice is more lucrative than judgeship, which might then sway one's
intentions.
Not at the cost of spending years doing clerical tasks like photocopying,
drafting briefs, or running errands for seniors, just to ‘earn’ the right to sit
for the judiciary exam.
Not at the cost of a dream that many women and underprivileged students
carry—only to have it crushed by socio-economic and cultural pressures.
Unfortunately many of the dreams might get killed just because society beliefs
that the daughter should be married as early as possible just after her
graduation. Many of them are privileged only till graduation, later they are
pressurised to get married, ultimately killings of a dream which they could
achieve if they get the chance to crack down judge dream in later graduation
days.
And to all the 'products of patriarchy' and 'philosophers' who sees this as a
victim card or believe nothing can kill your dreams and nothing can stop
you,trust this when i say,sometimes dreams do get killed,sometimes people get
stopped because there's no choice left to continue.
