Women from law's perspective

Women are those who needs no care of attention neither any kind of love and are easy to handle. It definitely seems a definition of an object but it's the sour truth and the exactly the condition of women in our nation. Even the way women are defined in religious context is very melancholy i.e. in the Christianity women are defined as:
Although women are spiritual equals with men and the ministry of women is essential to the body of Christ, women are excluded from leadership over men in the church. And it's not complete yet in Hinduism a woman's duties include physical and emotional nourishment, reverence and fulfillment of her husband and her children.

Therefore, these simply typify that the women are none but an object which can be easily handled. Even in the 21 century the condition is not improved yet. But, we can say that the condition has been improved from last decade and that is very much visible as well. But it's not like that the women are one who always faces problems but sometimes they are ones who are responsible for a problem and even they are the guilty.

Problems faced by women

The list of the problems is not short and neither stubby, it is something which cannot be displayed in a single sentence or two. The problems are being faced by both kinds of women working as well as home makers.

According to stereotypes, problems start when a women step out to gets some penny for his family but what when a woman is a house maker? The answer would be nothing but the silence and that silence simply depict the answer. Problem is not that they won't be able to coup-up with others but the problem is that people are not giving them equal opportunity as everyone gets.

There are many problems which both homemakers and working women face and they are follows:

  1. Acid Attack
  2. Rape
  3. Child Marriage
  4. Honour Killing
  5. Trafficking
  6. Sexual Harassment
  7. Dowry


And the list continues.... All these above mentioned problems were based on the legal perspective. There are many problems which are not legally mentioned but they experiences like Accusation of witchcraft, this is something which women and children both faces on the other hand women do faces problems at workplace as well like sexual harassment at workplace. These offences are both legally and ethically wrong but, then also we practice, why because there is no such strong and overpowering body which can govern us on this particular topics.

Laws for the safety of women

We cannot keep safe women nor anyone else unless and until, people themselves initiate to protect other and stop infringing others rights.

But then also there are many laws which are there to protect women and they are as follows:

  1. Dowry prohibition act, 1961
  2. Indian divorce act, 1969
  3. Immoral trafficking (prevention) act, 1956
  4. Married women's property act, 1874
  5. Child marriage restraint act, 1929
  6. Sexual harassment of women at workplace act, 2013

These are laws by which women's rights can be protected. But it is very ironical that one who makes law sometimes is one who breaks the law. The proofs are many it just that we need we head up and turn around.

To ensure more security to women there are some more statute and principle:

  1. A women cannot be arrested after the sunset and before sunrise.
  2. A women can lodge an FIR at any police station irrespective of the place of crime and the cops cannot refuse.

These are some more postulates to keep women more safe and secure. But the question is whether they are safe by having so much law and statute. The answer would be something which needs no attachment. The reason is very simple that we (the people) are the one who don't allow them to have progressive lifestyle.

There are many cases by due to which the conditions of women have been improved.
And few them are mentioned below:

  3. Domestic violence- V D Bhanot v/s Savita Bhanot (2002) 3 SCC 183
  4. Dowry death – Pawan Kumar and Ors. v/s state of Haryana
  5. Acid attack- Parivartan Kendra v/s UOI 2015 (13) SCALE 325


Initiative by the government for the welfare of women:

  1. Mahila E-haat
  2. One stop centre scheme (Sakhi)
  3. Swadhar ghar
  4. Nari Shakti puruskar


Conclusion
Women conditions cannot be improved unless and until we impart any efforts. And it is also important that women themselves should come up in front and fight for their rights. And the other side of the coin would be that we have to give them same opportunity as other people get.

Historically it has been proven that in the Indian society women were not getting same level of respect and honor as they deserve and now its high time that they get what they deserve. And at last I hope that after reading this, you can make a rational judgment towards them and give them same respect.
