In a patriarchal society like India women are considered as pride, prestige,
and honour of clan. Reputation is the primary reason which lead to honour
killing and give birth to a new crime. India acknowledging the largest democracy
in world history, couldn't get women out of ancestral clutches where her
fundamental rights and choice is overstepped. Even after 75 years of
Independence of our country such enormity of honour killing still breathe in our
society.
Our patriarchal community belief that a women righteousness, morality and
rectitude belongs to her untorn hymen.
Honour killing is assassinating a person, who stands against the marriage
arranged by the family or chooses to move her/his nuptial life as per her or his
desire just because it brings shame to the family or community. They believe
marriage or liking should be between people with same status, caste, and
religion by choosing a person with different faith inflames disgrace to them
such stigma gives validation to slaughter a man and snatch his rights and
freedom to live. Honour killing violates article 14,15(1)&(3), 19,21 & 39(f) of
Indian constitution.
The terror of losing reputation in the society involve mostly the male fellow of
family to take the brutal act of honour killing in practice.
Inter caste marriages are the massive reason for honour killing in current
scenario.
Case of Manoj-Babli the honour killing of newly wedded couple in 2007,
from Karora village in Kaithal district, were brutally murdered by Babli's
relatives. The crime was executed on the orders of a khap panchayat, for
marrying in the same gotra. On June 23, two decomposed corpses were found from
Barwala branch canal in Hissar.
Honour killing is mostly accelerated in north part of India Hariyana, Uttar
Pradesh and Rajasthan. It not not only stick to the remote areas but in
metropolitan area too. In 2008
Arushi talwar and Hemraj banjade case left the Nation terrified.
Honour murder are triggered by:
- Women seeking fundamental rights of education, speech and living.
- Women wearing attire which are revealing and unethical according to the
society.
- Seeking divorce.
- Going against the folk tradition.
- Sexual intercourse before marriage.
- Marrying outside the caste and creed.
- Marrying the same gender ( gay marriage ).
- Rape
Acts preventing Honour killing:
India Majority act:
Section 3 of act, Age of majority of persons domiciled in India. Every person
domiciled in India shall attain the age of majority on his completing the age of
eighteen years. That's means 18+ are adults who can consume there rights and
freedom. They can take decision of there own life.
Domestic violence act:
Women is restricted or denied from marrying the person of her own preference it
amounts to emotional abuse of the women under domestic voilence act 2005
Special marriage act:
The Special Marriage Act, 1954 is an Act of the Parliament of India with
provision for civil marriage for people of India and all Indian nationals in
foreign countries, irrespective of the religion or faith followed by either
party.
Conclusions:
Murder can never give rise to honour of family, it is absolute dominated under
the title of religion or faith. Honour killing are brutal and disgraceful act
which is still rooted in our society where basic human rights are shattered.
Judiciary has played a vital role to punish the culprits but many a times such
cases are not reported. Society need to be more enlightened on such end. Ethical
value and tradition should not be used as a weapon.
Every person has right to live respectfully with his own decisions in life and
nobody have the rights to overstep that.
