Child custody after second marriage
« on: June 06, 2017, 09:22:37 AM »
Your experts advice is requested here. I have married a divorce and she is having a son about the age of 13. It's been two years that we are married and I have been taking care of all his needs for past 4 years. Her ex-husband has not shown any interest in kid from his date of birth till now. I consider him has my own son and not even planned a kid for  our self considering him. Now she is been demanded by ex-inlaws and their family to hand over the child to them. Are there any law which can help us retain our son with us?

They can demand Taj Mahal also, what does it matter.

The child is 13 years old now, what the child decides to stay with is what the courts will give paramount importance.

Child's wish is final now.

We are being  forced and disturbed often by my wife's x-in-laws asking for our son. They even threaten us saying it won't taken them a day to take our son by law. We like to know do we have strong points on our side to have our son living with us.

Your child is 13 years old now. Now it all depends on your child. His wish would be the final decision.

if its a boy he can choose with who he stays in the court. But till the age of 14yrs boys are alowed to stay with the mother. Get hold of all supporting documents on how many times the boys 1st dad has visited and met the boy or been in touch with. You are says ex-inlaws have asked for custody rights. Well when father isn't interested their petition wouldn't stand much ground.
Also you can take restraining order to prohibit any unauthorised visit to your child by 1st husband or his inlaws.
