Abstract A significant departure from India’s colonial history of forced expropriation under the Land Acquisition Act, 1894, was signaled by the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (“2013 Act”). The 2013 Act, which required transparency, public purpose scrutiny, and rehabilitative assurances, reorganized the relationship between the State and the individual. It was based on the constitutional ideals of equality, fairness, and participatory justice.
