Abstract: The law of limitation is an essential part of procedural law which provides certainty and finality to litigation. However, to ensure justice is not sacrificed at the altar of technicality, Section 5 of the Limitation Act, 1963 empowers courts to condone delay in filing appeals or applications beyond the prescribed period, provided “sufficient cause” is shown. This article analyses the concept of condonation of delay, examines the scope of “sufficient cause,” and discusses landmark and recent judicial pronouncements, including the Supreme Court’s ruling in Pathapati Subba Reddy v.
