Abstract: The law of limitation is an essential part of procedural law which provides certainty and finality to litigation. However, to ensure justice is not sacrificed at the altar of technicality, Section 5 of the Limitation Act, 1963 empowers courts to condone delay in filing appeals or applications beyond the prescribed period, provided “sufficient cause” is shown.
