The unorganised sector, constituting nearly 90% of India’s workforce, remains the backbone of the economy but continues to face insecure employment, poor wages, and lack of social protection. Despite constitutional mandates and judicial activism supporting labour rights, statutory protections like the Minimum Wages Act, 1948, and the Unorganised Workers’ Social Security Act, 2008, have been poorly implemented. The Code on Social Security, 2020, reflects a policy shift by extending coverage to informal and gig workers, but enforcement hurdles, weak awareness, and bureaucratic inefficiencies undermine effectiveness. A universal, rights-based, and enforceable labour protection framework is essential for meaningful change.
