Foundational Principle of Bail in India’s Criminal Justice System The bedrock of India’s criminal justice system is foundedupon the upon the principle that ‘bail is the rule, jail is the exception’ as articulated by the Supreme Court of India in State of Rajasthan v. Balchand. This doctrine flows from the foundational presumption of “innocent until proven guilty”.
