Forced employment???
« on: February 25, 2013, 06:35:37 AM »

My uncle is in a trouble and I'm here to request an advice based on legal, moral, ethical, humanitarian grounds or any other grounds which might be relevant.

Here I go with my uncle's problem:

My uncle owns a medical business and quite a number of people work under him. Recently, his accountant was discovered to be stealing money. Apparently she (the accountant) had been doing that for quite a few years, but she was clever enough not to get caught. Recently, the cheating has been caught and she was repeatedly given warnings to mend her ways. But she continued doing the same stealing for more months. When all requests fell to deaf ears, she was fired. There was more than enough evidence to prove her guilty and the amount she stole goes quite high. But neither she is ready to refund the money she stole, nor accepting her fault. In fact, she's blaming everyone else for her fault!

Now she has seeked the helped of the local bhais (gundas). These bhais are now requesting my uncle to recruit her back, based on humanity (kid at home, drunk and unemployed husband etc.). However, no force or threat was used yet, neither by my uncle nor by the bhais. But the accountant is threatening my uncle that she'll ruin his reputation and shut his business down by false accusations.

In the current scenario, there could be two options.

option 1: She is hired back

1. Obviously, she might try to cheat again!
2. She won't return the amount she took.
3. She might seek revenge she had had been fired.
4. No guarantee that she won't make false allegations against my uncle or other staff he has.

option 2: She is not hired back
1. The bhais! Who knows what they might do!
2. The ex-accountant! Once again what false allegations she might come up with!

Now, the question is, what should my uncle do? Through me he's requesting an advice based on legal, moral, ethical, humanitarian grounds or any other grounds which might be relevant.

Thanks and regards!
