Organisation Forcing to Service Full Notice Period

Sir,

I'm working in a Software Company in Chennai.  In my Offer Letter its mentioned "Your Service may be terminated by either party by giving 90 days notice period in writing or 3 months gross CTC in lieu of notice.  However, the Company reserves the right not to accept payment in lieu of notice and enforce the notice period."

Now I got a very good Job and want to join in my new company in 60 Days.  But my manager is not accepting to relieve me in 60 days and asking to serve 90 days. I spoke to my new company HR, but he is asking me to join in 60 days as I agreed during the interview.  I agreed because they relived few people in 60 days and moreover I have leaves for 30 days.

My Question is:
1. Do I need to survive my full notice period; I can't force the employer for relieving letter without providing full notice period?
2. Iím planning to file a case against my manager, please suggest me some idea on what case I can file and how can I proceed?
