Termination in Notice Period

Hi ,

I am serving notice period of 3 months{from 10th OCT 2013 till 10th JAN 2014} in my current organisation, and my employer has also mutually agreed over the mail, just for an update , so far i have not given any resignation or received an termination ,

the main reason i was forced to resign because they wanted me to RELOCATE IMMEDIATELY to gurgoan, i told it is not possible since my kids are in school and they are in middle of their academic year , so i cant relocate now,

this is where the main problems started and i been forced to resign, and my employer started sitting behind my back , what ever i do from then on ..is not productive for them ,

now they have sent me an mail, that this non productive thing is breach of policy and they want to terminate my service immediately

Already i am great distress and totally disturbed by their attitude in spite of all this they now want me to terminate

I wanted to relieve peacefully but they are pushing my temperament,


I am really in big agony , can you please tell me what to do?

Since you are any way leaving the job you should forward your resignation letter. as of now

I think you should try to talk to your boss, And also its not fair to terminate you as your notice period is not over yet. You can also make the legal entities to intermediate in between.

It is not fair to terminate you in your notice period. So, I think you should talk humbly to your boss and force him to fulfill your needs. Thanks

Since they have mutually agreed, the resignation has been deemed to have been accepted. Hence, you are serving the notice period.

If there is a transfer clause in the appointment letter, then you cannot deny the transfer.

There is a procedure for terminating the service of an employee for non/ less-production. First you will be given a notice to improve the production, if not then show cause -> domestic enquiry -> report of enquiry -> punishment (termination)



Though it is a very late reply but I hope it will help other readers to understand the legal position.
