Need help on recovery
« on: December 24, 2013, 08:05:00 PM »
Hi,

I am in a very bad situation, unable to get my own things from my exhusband 1.5 years after dicvorce.

He was mentally torturing me and I was so foolish to listen to his words. He used my jewels and all my salary for his needs. He threatened me that he will not give divorce if I dont agree to wait for 1.5 years to return everything. Also, he mentioned that he will return all my salary and I listened to that. It was not written in the divorce decree. As per the decree he had to return the jewels and some money that he took from my parents. The date is already crossed and he did not return anything.

I have the following questions:
1. What is the best way to claim everything that is written in the decree?
2. Since he did not even abide by the decree I would now prefer to get some legal aggreement that he would retutn all my salary that he took for his needs. Is it possible?
Thanks

1. What is the best way to claim everything that is written in the decree?

send a legal notice seeking compliance of the agreed upon facts in as mentioned in the decree sheet.

Non compliance of the said mentioned, would result in seeking court intervention.

he will give it once he sees the legal notice.

he cannot avoid the facts mentioned in the decree, because it will get him in Big trouble

Sir,
Thanks a bunch, for your reply. Currently am abroad on an assignment. Can my parents send this legal notice? Does this mean that my parents may need to appear in the court multiple times. Is there a possibility that the opposite party can drag this for so many months and years?

Thanks

yes your parents can file on your behalf give them the power of attorney to that affect. they can engage a lawyer on your behalf and get this thing done.

also the lawyer can file for exemption of personal appearance of your parents in court due to old age, your lawyers' presence is required in this matter
