My employment offer termination clause reads as follows:
Notwithstanding what has been stated above, if at any time, in the opinion of the company, you are found guilty of dishonesty, false declaration, absence to adhere to professional obligations, disobedience, disorderly behavior, negligence, indiscipline, absence from duty without prior permission or of any other conduct considered by the company to be detrimental to its interest or breach of any one or more conditions contained herein, your services will be terminated immediately without notice or compensation of benefits in lieu thereof.
The services could be terminated either side by giving 90 days notice in writing or adjustment/payment of three months GROSS SALARY in lieu thereof. If you terminate your services, you shall serve the notice period of 90 days without availing any leave during the said period.

My Manager has been harassing me a lot and I availed few days of paid leave following which I decided I cannot work with him anymore, hence I sent my resignation to the company. Even though I am a victim of harassment my employer is tormenting me to pay the money for notice period. Moreover the GROSS SALARY. I will not be able to pay them and also I have given them my resignation stating the reason.

My question is, is it legal for any company to ask for 3 months GROSS SALARY? Considering my case.....should I still pay him? Also I had availed my paid leave before resigning does it account to Mala fide?

U have a case send a legal notice to the company for unduly making life in office miserable so that u are unable to attend office, thereby trying to cheat you off your salary..

 This will make them dance
