My case is the building belongs to me and subject to corporation tax, metro water tax and EB all in my name. We assumed the (Gramanatham) land belongs to temple and paying rent to temple for past 25 years. I have ten tenants in my building, all paying rent to me and Iím paying rent to temple for land alone.
The temple trustee joined hands with my power agent and got one eviction order like remove the super structure and hand over vacant land to temple for non-paying of rent. The court didn't give chance to us, anyhow all over now. EP ordered in favor of temple.
But thing is trustee is not executing the EP and asking us keep the possession and demanding us money.
Few months back, Highways Dept gave notice for metro rail project and said this land does not belongs to temple (does not have any parent document) and it is gramanatham.
1. Is there any shortcut or chance to get stay in EP ?
2. Why the trustee is not taking possession?
3. Trustee need to prove ownership for executing EP?
4. If trustee brings new tenant, is he wants to prove ownership in lease deed (mentioning parent document)?
5. What will happen to my tenant, who is paying rent to me?
6. Is any chance that my tenants can help me, in this situation?
Something is stopping trustee to take possession, we can't understand why. If he brings new tenant he can get in crores. He is such money motive fellow but he is not executing EP.
Instead he is daily threatening us that he will execute EP, if we didn't pay the money he demands.
So please let us what is stopping from trustee side.
i discussed with my lawyer. He says "you accepted him as land owner and paying rent, also in suit you accepted him as owner so now you can't take second stand in your case.Any how he is your land owner, you don't have rights to file title declaration now."
Also he says "he holds pure eviction court order in his hand, why he needs to prove the ownership here, just eviction order is enough to evict you. There is no need of deed or ownership proven here to evict.
