Agreement of Sale

I am selling my flat for 40 lakhs and the buyer is insisting on having 2 agreements.
One with 32 lakhs which will be registered. Other one with 40 lakhs and will be on a stamp paper signed by a notary.
The difference of 8 lakhs will be mentioned as repairs and renovations or cost of furnitures etc. Will this be OK ?
 
I am planning to show the whole 40 lakhs in my tax returns. So Is the notary agreement legal from tax perspective and will i have to face any issues by favouring the buyer in reducing the stamp duty ?
