Deny Child custody and visitation rights to husband

My dear friend separated from her husband after a year of marriage, at the point of separation she was pregnant,  the reason for the separation was physical beating and ill treatment.

there was no police complaint made by my friend or was there any legal litigation.

Now my friend's son is 7 months old, she wants to know whether her husband can take her child away from her? also is there a way to prevent visitation rights of the father

The paramount consideration is the welfare of the child, as in matters of Child custody.

As a general rule in most cases child below 5 years are given to the mother, but that does not mean this is a trend always.

again regarding denying visitation rights to the father, well If there is an order from the court granting your husband visitation rights to your child, you may appeal to the same court to set aside that order or file an appeal before the appellate court.

My cousin is in the same situation as well. They got separated within a year when she was pregnant. The guy never supported my cousin emotionally or financially. After seperation the guy keeps sending derogatory, abusive, and intimidating emails to my cousin and her family members (sometimes he even includes my father(girls uncle) in these defamatory emails). They are not divorced yet.

Please could you advice if we can take any legal action on him so that he stops sending these kind of emails. We are a joint family and we want to get rid of this unwanted harassment.

Also, the kid is around 4 years now. He never paid for the hospital charges during pregnancy or after. He never took responsibility to pay for the expenses of the kid in last 4 years. It is my cousin who is taking all the responsibility. In this scenario, can he still claim for the custody of the kid? My cousin even wishes to stop him even from visiting the kid.

Please could you advice the steps she needs to take to keep the custody of the kid and deny all the rights on the kid to her husband.

Denying visitation rights to husband is very difficult. Can u convince the court that the husband is abad influence to the child or is if bad moral character or a habitual drinker etc only than can u deny visitation rights
