Property Settlement without original document

My Father-inLaw owned a house in his name, He is orally telling that he want to settle the house to my husband name(as my husband is taking care of him and spending money for the house construction). My husband has 2 sisters(married) and 1 mother. And the original document is in with my Father-inlaw's brother's (say Y) . The Y is not giving back the original document, saying that he has kept that doc. for getting loan( might be with some person who gives loan for documents).

Now I have a doubt that ,

1) Without the original document can my father-inlaw , settle the property to my husbands name.? NOTE: My father in law has duplicate docs.
2) if not what will happen to the property if my father-inlaw dies in future?

If the property is in your father In laws, than how can his brother get loan in the property and also who is he to surrender the iriginal property to the money lender and why will the money lender accept this.... Something is missing here..... Anyways your father in law should make a registered will that will be enough

1) Do my father-inlaw need original document to write WILL? Is the duplicate is enough?
