Suggestion against Tenants

Dear Sir,

I need a advice from you.

I have a property and with that TWO different tenants.
One is living with us for 30 years.
Another is living for 15 years.

I have a son, recently married.
For them, I need rooms. They currently stay in 2nd floor (top floor) which is like a hall room. One room, one baranda, one bathroom.

In Winter, the room gets very cold at night and in summer, its like a micro-wave oven as its a top-floor with glass windows.

For these I need to vacant my tenants which they refused.

Now, both the tenants bought their own flats in the same city that of mine.
One is living their own flat, but kept a servant in our room.
Another is living in our room, but put tenant in their flat.



Please suggest me how do we progress?
What is our chance?
How long 'aprox' will it take?


My main concern is that, they will claim that we do have extra room so our requirement is not valid.


P.S. I am from Kolkata.

File an eviction suit stating your requirement for the place. Chances are u will get it back. But the way legal process works in your city ot will take time.

In the eviction suit make sure u give concrete proof of the tenants owned flats. This will be helpful in getting them out very easily

Get some local goons and vacate it and immediately get the place renovated in such a way that they don't appear the same as before. This is the best proven technique from Mumbai city. Court and all is a long process of frustration

We had sent Notice to them.
Now we have filed a Case against them.

UPDATE:

as the case is on-going, one of the tenant started keeping couple of "paying-guests" but initially, they told us that they are their relatives, came to Kolkata to see the Durja Pujo. But then we realised that they have placed paying guests into our own premises without any of our permission. But we can't proof anything......

When my daughter, started asking them "who they are / why they are coming here etc."..... just because we feel insecure.
unknown people living, more unknown people coming to meet them..... hope you understand the situation.


Today, the tenant filed a complain to police against me (landlord) and my daughter saying that we are harassing them and their relatives and causing passage problem.

We have to go to the police-station.
