Can a surviving parent having two properties settle those properties jointly on their two children (instead of one property for each child)?   It would be  a conditional transfer where the parent would continue to enjoy the benefits of the two properties during their lifetime (rent, etc) and the properties would pass to the two children jointly on the parent's death.

The reason is that the properties are not equal in value and the children would rather settle that issue after the parent's lifetime.  For now they just want the asset to be transferred to the next generation to avoid the higher stamp duty in the event of the parent's death.

If your father transfers now he cannot apply any condition at all. And yes such transfer will require stamp duty. Now your father should make a registered will, than after your parents death property will go to both brothers as par will, by way of mutation where there is no question. Of stamp duty. Its FREE
