Property bought in other's name
« on: June 05, 2014, 05:56:43 PM »
It will be great help if some one can guide me , the post may appear a bit wired for some.
************************************************************************

My father was a political activist during 1970's and was actively involved in Bengal's Naxalite movement at that time , though he was under cover. His usual job was as a Govt. employee in electricity dept. He bought a land during 70's with his own money but in the name of his younger brother ( my uncle ) and his elder brother's son ( my cousin ), who were small kids at that time. He did this because he thought if he was caught by the police/govt. his property can be forfeited due to his Naxal identity.

In 80's my father was a non-political civilian again and he married and I was born.

In 90's at my age of 10 , my father died. But before that he urged my uncle and cousin ( who were adults by then )  so many times to return that land back via Gift Deed. That never happened.

A few years after his death , they forged the papers of that land and sold it to some one. I don't know who they are.

My question is - I still have the original paper of that land , is there any remote chance that I can claim that land in any way ? I know it is now a prime property ...

Any clue will be great help ...

Prime facie evidence is in favour of your relatives, i suggest you forget it.

when the property is in your relatives name that to done by your father wilfully.
