If a person has purchsed some products worth rs 7.5 lacs from X co.but he is delaying the payment to X co.after so many request to pay the outstanding dues this person has given a cheque amounting rs 3 Lacs which has been bounced  due to insufficient fund.when Co. X informed him about bouncing he assured he will pay the amount within one week but week after week has been passed but he could not pay the amount even 8 months after the date of bouncing, when my legal advisor talked with him and inform him that are going to serve him legal notice he deposited rs 3 lacs in the a/c of co. X.But remaining rs 4.5 lacs is still pending even after 12 months from the sales date and9 months from the bouncing date.now what should i do

You should have instituted case under S.138 against him as soon as the chegue got bounced, also the validity for cheque is only 3 months. Now you can not even re-present the cheque. Get another cheque from him and present it or if you have any post dated cheques make use of them. it will definitely bounce and then initiate case against him. In the alternative, you can normally file money suit for recovery of money. I am surprised why your legal advisor could not suggest you the right course of action.
