Domestic Violence
« on: August 11, 2014, 02:39:45 PM »
My parents have not been staying together for last 5-6 years due to my father's ill-treatment, physical and mental harassment he inflicted upon my mother. She used to stay with me (daughter, unmarried) or my brother. But intermittently, she would stay for some time at our village home where our father lives on specific occasions.Even on those few days my father's behavior is unbearable beset  by physical beatings,at times. She is deprived of proper food, medicine, and such other things when she stays there.1 day back,my father threw her out of the house at 11 pm,night time and then she took shelter in another person's house. He snatched her mobile and phone diary also so that she cannot contact any of us.He also kicked and punched her quite a few times before throwing her out.
We have tried our best to reason with our father, but he doesn't care. He's a retired school teacher and gets pension regularly. He is reasonably good to us(2 sons & 2 daughters) but has such behavior only for my mother. In addition to that,he also has other clandestine affairs with other women. We didn't lodge any legal complaint till now as mother mostly stayed with us, and we just gave it up.But after what happened last night, given that my went there at his behest as he had gone through a surgery, we want to take some legal action against him.I am bit familiar with 498A.Is there any other section we could use along with this?
My brother has built a house in our village land. The land has not been divided between my father and his brothers yet.So the house is not registered in anyone's name yet.As a result of a police case,in case he wants to take it out on us, can he give that property away to someone else? There are a few relatives who seem to waiting for that opportunity.
Kindly help in how should we proceed.

We brothers and sisters are reasonably well off. So can support her.Hence what we want is more like revenge.
