Moot court problem: I am stuck Art.300

I have been researching on my moot problem for a week still I havent achieved any breakthrough.
I have got the answers for 2 issues in my moot problem but third issue is torturing me.

Problem- I am the respondent , The case is Kasturilal v. State of UP. States liability for the act of its employees.
The issue before me is - Is the case maintainable under Art.300? The case is maintainable but me being a respondent I have to state how the case is not maintainable ,
Can anyone help me out? Even a hint will boost me up. I just need a que , I am stuck
