breach of sell-puchase contract
« on: September 21, 2014, 03:23:21 AM »
Hello,

I need an advice from an expert legal advisor for the problem I have been facing.

We are living in one rented house for last 15-17 years,we are sharing the same tenament with owner(Where he lives in upper part of tenament). Last year owner's financial condition deteriorated and he was in a desperate need of money on a urgent basis. Therefore We had asked him to sell the entire house to us in decided amount. He agreed at the moment and we gave A amount to him and made a legal contract on stamp paper (In that contract it was mentioned that owner has to vacant his house in coming 1 months as they will have to find a house therefore time period was given and during this one month If he does not want to sell his house then he will have to give us A amount + additional 1 lakh rupee as part of interest else he will have to vacant house and we will give remaining amount to him.) After 1 Month, When we told them to vacant house then he refused to do that and was telling us I will give you the amount which you people gave me means only A amount not additional 1 lakh rupee but with no time period.

Therefore we had filed a case against him with all the necessary documents bu unfortunately its been 3 years we did not get any results where our case is pretty clear, I dont If our lawyer is not active or should I need to change my lawyer? Case is running in civil court only.

Now he has started to harassing us as well, Abusing us, not giving space to park our vehicles and always staring at our house.

Need advice on a urgent basis..

Awaiting for your reply.

Thanks,
Rajiv

We have logged a case for breaching terms and conditions even though time period is over mentioned in contract. neither our money is release nor he sold his house to us. We are ready to give remaining payment but he is not vacating house nor the money.
