Class I heirs partition proportions
« on: October 07, 2014, 11:19:58 PM »
This is in regard to continuation of another post Daughters right towards an ancestral Property

Can you please clarify into how many Equal parts will an Ancestral property be exactly divided in our case...

5 parts (2 sisters + 3 my mother, me & my brother) as we all come under Class I heirs that are alive right now

3 parts (as there are only 3 children (my LATE father & his 2 sisters) even though my father passed away, is it that only his part of share will be given to us)

Please reply as we all are confused whether it is 3 parts or 5 parts.

Note: Property is for sure an ancestral property and no Will was written & neither partition was done prior till now .

My Grandfather, grandmother and my father (born in 1954) passed away many years back. My grandfather had 3 children - 1 son (my father) and 2 daughters.
1. 1st daughter (elder sister to my father) born in 1950 & got married in 1974
2. 2nd daughter (younger sister) born in 1964 & got married in 1987
3. We are Hindus & the property is in Andhra Pradesh
4. Our Family: My LATE father has 2 children (me & my younger brother) and my mother
