Legal advice for divorce
« on: October 29, 2014, 05:14:24 AM »
Hi,
My name is Shoeb Mohammad. I'm 36 yrs old. I got married in the year 2006. I have 2 kids, 7yrs old daughter & 3yrs old son respectively. From the beginning of my marriage we both were facing problems with each other. Somehow we continued the relationship for rest of the years. From the past 1.5yrs she is not with me. She walked away with the kids to her parents. Till date she is staying at her parent's place. I had tried to call her back with kids but in vain. Finally I decided to break this marriage, however I can't find out any types of further procedure from their (her family) behalf and now they (her family) don't want to break this marriage . Although they are doing nothing but also they kept mum from their side. Please guide me legally (As per Indian Muslim Personal Law)so that I can go ahead with one decision because from my point of view there is nothing left in this marriage or relationship.

Thanx & regards,
Shoeb Mohammad

Hi,
Thanks for your guidelines. However few more things I want to ask is as follows:
1. What are the legal consequences in the whole procedure of divorce
2. Whether I am on the right path (As per the Indian Muslim Personal Law)
3. Can I get the custody of my children
4. Do they have the right to claim the compensation

Thanks & regards,
Shoeb Mohammad
