Settlement Deed
« on: October 31, 2014, 10:02:29 PM »

My  father-in-law and mother-in-low  have distributed the properties among their children, through settlement deeds.  My wife is given a property through separate settlement deed.  We live in the same property along with my in-laws, for the past 18 years.  Other Children are living separately.

The property is bought by my in-laws from their own earnings.  It is not heritage property.

The settlement deed states that my wife become complete ownership with  the rights ( sell or mortgage ) only after my in-laws demise and it is categorically mentioned that the settlement deed cannot be cancelled by them, during their life time.

The settlement deed is registered with both the parties signatures ( my in-laws and my wife) at property registration authority in 2007.

I would like to know

1.   Whether the settlement deed can be cancelled by my in-laws, for the reasons which is known only to them ( may be influence of other children), without my wife’s consent/knowledge

2.   If so, what are the legal options available to my wife.

Kindly advice.

With kind regards

since the agreement has been entered into by both parties.
it cannot be cancelled without the consent of the other.

But in this case the property is solely in the name of the in law hence she can do whatever with the property at her will that is sell/rent it out etc anything.

thereby the contract entered between your wife and in law is useless

Thank you very much for your clarification.

I would like to kindly request you to help me to understand that when the partition deeds are executed, some of the partition deeds, the owner retain the some of rights till their demise.  Whether those partition deeds also invalid?

Please help me to have better understanding.

With kind regards
