What If I file divorce first. My wife is employed, she has desserted the house twice in last one year on her own, she's staying in her sister's house. I got married to her in 2012. We dont have kids. No dowry was taken, we shared the marraige expense equally. My quesion is if I file a divorec first can she press false charges against Me & My Familiy?

Whether u file first or second it really does bot matter, if she has to file anything against you she can.

why dont u sit with her reason out and file for mutual consent divorce, that would be apt

Thanks for ur suggestion, really appretiate. I have another quesion, mine is a rented house since my native is another city. She has left this house and taken all the things belonged to her even my towel which she bought for me, except some marraige present which she received from her family like: Fridge, Sofa, Bed, Wadrobe. Now I want to shiftout from that house to some other locality nearby. My quesion is Do I have to inform her about this? is there a legal binding that I have to take her concern before shiftingout as she is not staying with me?

Well clearly ''advmishti'' & you doesn't mean about the word 'Desertion'. Well you can't file the petition for Divorce(at this point of time) on the ground of desertion because the basic essential for it is that the spouse has left the matrimonial home for not less than TWO YEARS before immediately when the petition is filed , which time period is not available in your case as the facts you stated.
