Ex Parte Decree challenged after 8 months what is the remedy
« on: November 19, 2014, 09:42:49 PM »
Can you kindly advise why the Courts in India permit re-instating the
Suits even 8 months or more after the Ex Parte Decree has been issued
against one of the parties? What is the remedy?

Ex Parte Decree can be challenged at anytime because the decree was passed in the absence of the other party.

If the other party can convince the court that the decree was passed without complete knowledge and the court is convinced beyond reasonable doubt than it will entertain the matter again.
