Change of name for wife
« on: December 03, 2014, 04:43:53 AM »
Hi,

I wanted some guidance on the gazette publication for my wife's name change.
We have applied for change of name to change her middle name to mine instead of her father and also her surname changed to mine.
I currently live in UK and I was planning on applying for her dependent visa after her name is changed.

But I realised that in UK it is not mandatory for wife's name to have her husband's name as middle name and her husband's surname in passport.
In other words, she can apply for the dependent visa right away on her current passport and name. This would save us all the hassle to get the passport (and PAN) card changed.

But then, if we go ahead with this, this will contradict the gazette certificate which will state the name has been changed.

In this scenario, I wanted to ask if we should continue with the old name for visa, or is it mandatory for her to change the name in passport and then apply for visa?

Regards
OJ

I suggest do the change of name once and for all and than apply.

this will be a permanent solution.

even though change of name is not mandatory

I do not know of any possible bottleneck in having the change done on passport (re-issue), hence this seems a bit of risky. If it takes time for whatever reason, she will need to stay in India until it is resolved. My passport is due for renewal in 2016 and I was thinking of getting passports of both of us updated, with each other's names endorsed in the passports, and her name changed in passport and subsequent visa.

But the application for gazette publication was done without this foresight. Hence I was assessing, if there are any legal implications of going ahead with passport with maiden name for visa. There may be inquiries by UK VISA authorities, or even passport authorities when we would be renewing her passport later on.

Thanks for any advice, appreciate it.
