Divorce by Mutual Consent

The husband and I are intending to split. We have been married for last five years or so. We have been staying separately, due to our work schedules for the most part of our marriage.We have not been able to register our marriage due to this.
Now, due to irreconcilable differences we have decided to go separate ways. We dont have any children. so no custody issues.
Nor do we have any joint properties. I have decided to give all the things he bought me back. (That includes gold, car etc).

There are two questions.
We were married as per brahmin wedding style. since we havent registered the wedding, do we need to go through the divorce, before he can re-marry?
What is the procedure for divorce by mutual consent? and approximate costs?
Our staying separately due to our work counts as a one year of separation?

I am based out of Chennai currently. Husband is in Bangalore.

it takes 6 months and two court appearances to complete a mutual divorce proceedings. in your case since there is no question of alimony and child custody it will go smoothly
