Divorce - Husband alcoholic/abusive

Hello All,

I am posting this question on behalf of my mother.

My parents have been married for more than 30 years, they are  late 50s. My father is a long time alcoholic , unemployed and he has been in and out of rehab multiple times. But things have only gotten worse recently and he is abusing my mother , using swear words and also physically abusing her. It has got to the point that my mom cries everyday in despair.
They are living in a house which is under the name of my mother.
My mother wants to divorce now. Could you please tell me how to go about this? Since my father does not want it MUTUALLY.  He is against the divorce . What can be done in this situation? Are there any laws pertaining to expedited divorce in this case given the alcoholism and abuse? what should be done in this case given that he will not sign any papers for divorce himself.
Advice would be deeply appreciated.

your mother has to file for divorce under mental cruelty, it will take a lot of time since your father won't be consenting to the divorce

But, are there no laws to help since this is an alcoholic abusing his wife!!? Long time meaning how long?

Find a Alcoholics Anonymous meeting room in your near by place. Threat him 498A if he doesn't attend it. Alcoholics are very fearful and weak in heart. It might work. He is sick only and needs your help. Find him a AA meeting room as early as possible.

Your mother can file a Divorce Suit on cruelty ground in Family or District Judges Court .Your mother can also file a petition for alimony in the same Court or can file a maintenance in Judicial Magistrate Court,but she should be separated from your father.--------------------M.Bhadra,advocate at Kolkata,9836589246
