Is there a law in India where forced marriage can be annulled?
« on: January 04, 2015, 09:40:13 PM »
My friend was in a relationship with a guy in college and she was very happy. Her father came to know about this and yesterday he got her married to some guy he knew who was a family friend.
My friend cried but no one listened to her. They took her to the registrar office and there he made her sign on the papers to make her married legally. She is completely lost right now.
This is a slap to women community in India and still we see how they are forced in every aspect. I want to change that and i need your help people i really need your help. Its a very serious issue and i need ways to make this marriage get annulled.
She is 23 years old so age was not an issue for them.

marriage cannot be valid if it is done through force.
the Marriage act is very clear on this.

Now who are you here// I guess nobody.

to get the marriage annulled the girl has to first make a police complaint than she has to file for annulment.

you have no role here everything the girl has to do

Ask your friend to lodge a complaint to the Police and file Suit for Annulment of Marriage in District Judge or Family Court. She can also file a Criminal Case in Judicial Magistrate Court.----------------M.Bhadra,advocate at Kolkata,9836589246

I am new  law student and i have  gone through one scenario which is confusing me.This is the scenario ,A child of age 14 got married to a girl of age 8...the girl  was residing with her father until she completes 17 years of age  and came to the spouse house at the age of 17 ,Both have grown up and attained the majority age. ie 21 years & 18 years. The marriage is not registered legally. The guy is not willing to live with her as he couldn't feel her as his wife.
1)First of all ,this marriage is valid?
2)can he do a second marriage?
3)if so, what needs to be done for making the second marriage valid as per law?
4)If the girl side file a case against the boy after his second marriage, will it be considered in court as it is a child marriage(1st marriage)?
