PROPERTY DISPUTE BETWEEN TWO BROTHER

Hi,

Please assist me with below details.

  We have two properties in India , (2 tenements together - no.5 & 6 ) , now no. 5 is actually has tax registration on my name and no. 6 is on my brother's name which was originally of my father before he died.(so may be he got that from his wil) . But my brother is living in no.5 from last 12-15 years and not paying any rent but paying tax since then.

I bought this property and due to family clashes i left my own house but now I want it back.

I have papers , local municipal corporation registration on my name .

Is there any chance to get my property back...???

Note : my brother is claiming that he has my father wil , which states that no.5 was property of my father and he just gifted to me in past but now he is transferring that to my brother. Does this make any sense ???

Since your brother is in possession of the property for over 15 years, It will be very difficult to evict them.

Even though the property is registered in your name.

its going to be a long drawn battle could go on for many years.

why don't you both brothers settle the matter amicably.

My advice is : Its better to lose a property than a Brother
