Stopping sale of portion of ancestral land

Hi,

My brothers and I have inherited ancestral property (land in Haryana). Now one brother has signed an agreement with an outside party to sell his portion of the land. Rest of us want that he should sell his share of land only after the whole land is partitioned equally among all of us.

Can we go to the court and request for an order to stop his sale of share till the whole land is partitioned?

if the land is not partitioned how come he could earmark his share and sell it..does his share forms part of a huge parcel of land or his share is seperate
