Theft case - IPC 380
« on: April 07, 2015, 09:13:27 AM »
A known lady came to our house and theft gold jewerly around 1/2kg and left.
we realized that she robbed the jewelery & informed to police.
police went to her house and searche but found nothing and asked her to comedown to police station for interrogation.
we stood at that lady and started questioning and feared her about police.
she confessed that she took the jewellery and requested not to tell any one and will give back jewel in few days.
but we informed police. she was brought to police station and kept in their custody and asked about jewellery.
she mortgaged them at muthoot gold finance & marwadi(bania) and took money and cleared her credits with some people.

Police were good with interrogation for 1st couple of days and tried to recover the jewellery from bania & gold finance and brought down them to station remand.
and tried to recover jewelery, but bania & gold finance insisted for money to return jewelry.
2days later we found that the case is in ACP office(assi. commi. police) and bania , thief and no one is in police custody.
when asked ACP about situation he said we left the theif to bring the money so that money can be given to bania and gold finance to recover jewelery.

we were shocked and doubtfull about ACP and influenced the ACP to bring justice on the case.
But he told us to wait for 5-6days and give time to thief to bring money to justic the bania & recover jewelery. the accused lady is back home & enjoying her life.

we are clueless and doubtful about police action whether they are mixed up with accused ?

1.in this case how Police should Act to recover jewelery when FIR is lodged?
2. if police are caring about bania & gold finance to give money and recover jewelery and waits for lady to give money, and at the end lady dont bring money what should police do to recover money.
3. No confession statement was recorded from the lady so far? when it should be made?
4. what steps shall we take to get jusice at this point?
