home documents locked in bank after paying loan money
« on: April 07, 2015, 12:35:06 PM »
Hello Sir, I am Suresh, I have taken a home loan by providing original documents in the bank. Now I have paid total amount, but the bank manager is not giving the documents. Actually, in that home document, my mother mentioned that she is having two sons RAMU and Suresh, among them she is giving that land to Suresh after her death. That means I (Suresh) land belongs to me. At the time of taking loan me (Suresh) and my mother have signed in the bank loan documents. she expired now. In bank I have submitted her death certificate and i paid total loan amount. The bank manager asking that my brother has to sign on papers that he is not having any rights on that home. From olden days my brother is anti to me. So, he is not willing to sign. In the previous days he went to court regarding the home, court confirmed that land belongs to me. I submitted that court documents now as a proof that land is not in the name of my brother. Still the bank manager asking the no objection signature from my brother. My brother is not coming to sign. Can you please tell me the solution for this...

sir,
nothing to worry and panic..take it slowly
file a RTI  with the bank..if  it is a private bank ,register a complaint with RBI complaint cell on this bank and file a followup RTI with RBI on that complaint to pressurize the private bank.
your RTI questions should make the bank answer on why they cannot return it and if  they are  Ok to face any legal penalty for providing false info on the RTI with  respect to following procedure for releasing the documents..am 100% sure this will work.
go ahead with it..you documents will come to you ..in few months if not now...no need to beg you brother or anyone for this..
go to rtiindia.org for help with RTI drafting..good luck

Lodge a complaint to the Regional Manager of the said Bank and also Banking Ombudsman in the Reserve Bank of India. Send a Legal Notice to your brother and also to the Bank. If you have urgent requirement of deed then you can get a certified copy from the Sub-Registrar Office.
