NON-REFUND OF FEES BY BRILLIANT TUTORIALS

I had enrolled my son for two years IITJEE training at Guwahati centre of brilliant tutorials in  april 2011 and paid fees of around 102000/- by cheque.In late September/October there was 3 days holiday on account of durga pooja and all students were given leave. After holidays, when students returned to attend classes, the centre was not there and the place showed name of Bansal Classes.All faculties and center incharge went missing. I contacted the H.O. in Delhi over phone and i was told that there is some family feud as the founder has expired and money has been blocked as such fees and other expenses of centres have not been paid for couple of months. The news came in all prominent national dailies. I was told that the classes will be resumed shortly with Career Launcher (another tutorial) without any extra fees. But nothing happened. I wrote several mails but all bounced and phone also stopped response. Finally i had to admit my son to Bansal classes by paying hefty fees and he lost couple of months in this process. We had to undergo severe mental trauma and financial burden. It has come to my knowledge that BRILLIANT TUTORIALS has again started its operations. It has silently usurped money of thousand of students and after a gap of couple of years came back to business. How money can be recovered and company can be prevented from cheating parents and students again?

Is n't it late to file a case? which forum should be approached? should a criminal case be filed or consumer case? case to be lodged at which location?

Send a Legal Notice to the said Brilliant Tutorials to calling them for fund of fees, failing which you can file a case in District Consumer Forum for deficiency of service and unfair trade practice. You can also file a Criminal case u/sec.420 and 406 IPC in Judicial Magistrate Court for cheating and criminal breach of trust.

First you have to decide what you want to do. whether to give punishment for their fraudulent acts in criminal law or you want to recover your money with compensation and interest. If you opt for 1st one then you have closed your door for consumer forum and if you opt for later one then your door have been closed before Criminal Laws.

I would suggest that you should get the money with compensation and interest @ 12% p.a. till realisation of the said money with compensation cause getting him arrested is not your intention and criminal case will be dragged for 3 years minimum and the person will be in bail. So go for consumer forum having its jurisdiction.
