Propeerty acquired through E-Auction (SARFAESI Act)
« on: April 27, 2015, 11:21:49 PM »
I have acquired a residential plot through E-Auction from PNB ( SARFAESI ACT) in Co-op Housing Society and made the full payment to the bank.
However, the bank has not provided me share certificate even after two months resulting in delay in commencement of construction. The bank is of the view that they are not bound to provide society share certificate to me as the property is auctioned on 'As is where basis'.
The secretary of the society is not co-operating in this matter.

What are the legal recourse available to me against the bank as well as the Housing society.
I would need NOC from Society to approve my revised plan and share are required to be transferred in my name.

with regards

R A Trivedi
