special marriage act 1954
« on: May 07, 2015, 05:59:01 AM »
Hi I am looking for a little advice. I am a british woman and my partner is indian. We would like to get married in india so I have been looking at what exactly we need to do for this to happen, so I have been reading the Special Marriage Act 1954. I would like to clarify that we are not able to have a Hindu wedding, is that correct? And also it states that in a marriage between a hindu and a non hindu the person from the undivided  family (this being my partner who is a hindu) would be severed from their family as a resuly of the marriage under the act. What exactly does this mean??

Any help or advice anyone can offer us for our journey would be greatly appreciated. We want to have the full picture of our siituation before we jump in and start the legal side of things.

Thank you in advance

Hi. Thank you for your reply.
I have no problem getting all the documents together. I am happy to go through he process as is stated in the foreign marriage act but I have concerns about what it will mean for my partner and his relationship with his family. Ot says in the act that he will be severed from his family. What does that mean. They have met me. They know I am foreign and not a hindu and they are happy for the wedding to go ahead.

I agree that much of the information people read on the internet is of no use and gives the wrong impression. HHowever I read the entiee special marriage act 1954 and it is stated '19. Effect of marriage on member of undivided family.—The marriage solemnized under this Act of any member of an undivided family who professes the Hindu, Buddhist, Sikh or Jaina religions shall be deemed to effect his severance from such family.'
I simply want to understand what that actually means
