Conditions for mutual consent divorce

We were married 5 years back in November 2009 and our Married life is not being due to unnecessary conflicts with regards to communication,idealogy,ego and attitude. We both were not happy with each other lifestyles and hence we decided to go with Mutual Separation.We undergone enough of dramas and unnecessary arguments and ultimately we both are not happy and decided to go with Divorce. But i confused where to start with. We are separately living since 2 months. Can you suggest how to file a case, and what are the terms and conditions for divorce.

A joint petition has to be filed.
both you and your husband has to appear before the court twice.
total time 6 months.

do you have children and which city do you want to file

before that workout a memorandum of understanding between you and your wife on child custody, maintenance, sreedhan etc etc and attach it along with the petition for mcd.petition must be filed jointly.then 6 month cooling period.then first motion of mcd..recording of statements of you both..then second motion in another six months..still if you both want to divorce then mcd will be granted.the second motion can be postponed if required for another six months (ie)eighteen months from the time of presenting petition for mcd
