Hello Advocates,

Can some one disclaim rights for a partition of his father absolute property via a registered General Power of Attorney (GPA)?

Issue is: My father (not educated, not living now) was victim of fraud by his own brothers. He executed a registered GPA for something else appointing one of his brother as a power agent. Without knowing content on the GPA, signed and registered this GPA at the sub-register office.

Question is: In the GPA, have a line says that my father disclaiming rights for his father property. Is this valid in Indian court or Power of Attorney act?

Please advice. I am planning to sue my father brothers, wish to know more. Please share any court orders or judgments related to this issue.
