Property Issue with cousin

Hi,
My mother purchased a property from my uncle (My father's Brother) which he received from will of my grandfather. My uncle sold this land to my mother in 1992-93 to buy a new property. Now registry in name of my morher. My father and similar uncle was doing a small scale production work in partnership on the same property. Now firm is closed from so many years. My uncle expires 5-6 years ago but son of my uncle (my cousin) is not ready to leave property and asking for his share from the property (Firm is already closed). He starts his own small scale work there. Kindly advise what we can do in this manner.  :-\

lodge a police complaint on illegal trespassing of the property.

since he is not a tenant, police action would be apt

Thanks advpriyaanand for replying. Yes he is not tenant. We are in loss of 40-50K every month because same property can be given on rent. My father and mother dont want to go to court because of long hearing of indian courts, they think It took years to resolve these kind of complaints. If we go to court what will be approximate time for a respected court to declare there decision? Can we also claim for our loss ?
