Need a divorce

My wife started an affair and asked me to go for mutual divorce I have one son of 3 years.I tried to make herslef not to leave me and my son and now again she started to ask me for divorce is there anyway I can take one side divorce on this ground that she started an affair after 7 years of marriage. Also I spent a lot of money on her as her parents hide the chronic TB from me and my family before marriage causing to go for operation twice and forced me to spent around -7-8 lacs more than her father spent in her marriage,
Now I am fed up totally with her atitude for asking divorce all the time. Can i take one side divorce from her on this ground.

its always better to go for mcd because you can get divorce somewhere between 1 to 1.5 years whereas contested divorce might take 3 to 4 years easily.
you can go for contested divorce on grounds of adultery if you have enough proofs to prove adultery.record her statements where she admits herself of commiting adultery  and also gather e-mail proof and messages that they would have exchanged between them.if you have got any proof that they stayed outside together for a reasonable time.all this would help you to prove adultery

She wants divorce you want divorce.
Than why don't to file a joint petition for mutual divorce.
And finish the headache once and for all.

Hi Thanks for your valuable advice.
I dont have any proofs that she lived outside or not but I have some voice recordings where she admitted that she want to live with him and leave me also she sent some document proofs to him through messages. Does that will work.

Thanks for replying.
I need divorce also now but some questions are bothering me to go for mutual divorce:

1. Is it possible for her to take back the decision from mutual divorce.
2.In such case what should I do if she takes back step not to go for divorce, in that case what court decided because once the case if filed in court I dont want to let her back again.
3. After going for mutual divorce, can she file a case against me for anything like dowry or physical or mental torture.

You will need proof in various forms to show adultery if you want one sided divorce.But if she is also insisting to get divorce from you i don't think there is any trouble.You both can go to the registrar of marriage and file divorce easily.

Is it possible to take back the step after case is in court during the court decision is pending.

Ofcourse that is very much possible. At any point of tim, pending the divorce proceeding she files an application withdrawing her consent for any reason, then the whole petition becomes infructuous and you will have to file for divorce separately.

yes

you need to file a contested diovorce
3. After going for mutual divorce, can she file a case against me for anything like dowry or physical or mental torture.
mention in mou that she will withdraw all cases if anything existing as of now and also she wont file any case in future.suppose if she does inspite of agreeing in mou you can quash the fir in the high court u/s 482 crpc by producing the mou in the court
