parking allotment
« on: June 08, 2015, 09:56:54 PM »
Dear all,
I have purchased new flat in Thane and got possession in march 2013. In our complex builder has constructed the podium parking. Intially he sold parking with flat to those how are intersted and he mentioned it in agreement. But now for new "parking buyers" he is charging 6 lakhs (payment without cheque). and giving allotment letter .
If  a)I am interseted to purchase the parking then this allotment letter has any "llegal value" ?
And if b)  I am not purchasing the same ,then wheather I have right to park my car in society ?
c)Is there llegal way to ask parking space from builder ?
Til date society has not formed.
Kindly , provide me the guidance so that I can solve this problem
Thanking you in advance

If the original deed states that all the building allottees will be given parking space also then you can file a consumer complaint and get your parking space as you would have already paid the money. Never pay money that cant be accounted for. Since you have paid you have the right to parking space in your society you just need to file a consumer complaint in the forum.

Dear Sir,
Thank you very much for your reply.
Actually in our agreement it is not mentioned that builder will allocate parking.but those persons purchased same in there agreement it is mentioned.
Now he is selling the same with 6 lakha and giving the alloment letter only without registeration of same.
if I do not take parking, In such case wheather I have an right to park my car in open spaces?
and if I purchase then allotment letter has any llegal value.?
Thanking you in advance.

please refer to this for parking space - http://articles.economictimes.indiatimes.com/2013-11-25/news/44449837_1_car-parking-parking-area-parking-slot. this issue has already been addressed. You can park in a open space as long as it does not obstruct any road or interfere with any public or private rights and privileges.
