Forced Marriage By Care Takers
« on: June 21, 2015, 07:35:12 AM »
Hello Sirs,
I am asking this question to help my friend and request you to kindly provide me quick response as she don't have time to think. My friend is around 18-19 years old. She lost her parents (Both mom and dad) in an accident two years back. Her father was a central government employee and at retirement he got funds which he deposited on her name and made her uncle nominee. Now she is living with her uncle. Her uncle was taking all interest monthly by forcing her to sign and she has to do that. Now yesterday she came to know that they are getting her married without her consent. Things are getting worse. They are not letting her contact anyone, No one in the family is supportive for her. Is there any provision that after marriage funds and deposits can be encashed by any mean if her husband is favoring her uncle? Now what options she can seek to escape from this situation.
Please let me know. she is in urgent need.

If the funds are meant for her, then she would have been named as the nominee and her uncle as the guardian. Now that she has attained majority and there is no need for any guardian, she can give a letter to the concerned disbursing authority along with proof of her identity requesting them to deposit money in her personal account. In case of non-compliance then reporting to the higher authority will in all possibilities solve the issue. In the worst case she might have to file a writ of mandamus to get the job done.

As soon as possible lodge a complaint under Section.366 of Indian Penal Code as it is a punishable offence to force a woman into marriage and the police will file an FIR and proceed with invetigation.
